These Terms of Service (the “Terms”) govern your use of senditsoftware.com (the “Site”) and the text messaging program operated by Send It Software LLC (“Send It Software,” “we,” “us,” or “our”), including messages sent on behalf of our products such as BetterTickets (together, the “Services”). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
1. About These Terms
Send It Software is a software studio that builds and operates products including BetterTickets. Some of our products have their own terms of service. If you use one of those products, its terms apply to that product, and if they conflict with these Terms, the product’s terms control for that product.
2. Using the Site
You may use the Site for lawful purposes only. You agree not to:
- Use the Site in any way that violates applicable law or regulation;
- Attempt to gain unauthorized access to the Site, our systems, or other users’ information;
- Interfere with or disrupt the Site, including by introducing malware or placing an unreasonable load on our infrastructure; or
- Submit false, misleading, or unlawful information through our contact form or any other channel.
3. Intellectual Property
The Site and its content, including text, graphics, logos, and software, are owned by Send It Software or its licensors and are protected by intellectual property laws. You may view the Site for your personal, non-commercial use. You may not copy, modify, distribute, or create derivative works from any part of the Site without our prior written permission.
4. Text Messaging (SMS) Terms
Send It Software LLC operates a text messaging program for our products, including BetterTickets. By opting in, you agree to receive text messages from Send It Software as described below.
- Program description: Appointment and scheduling notifications, such as confirmations, reminders, and updates about events, reservations, bookings, and other services you have scheduled or registered for through our products.
- Opt-in: You will only receive messages if you provide your mobile number and agree to receive text messages from us. Consent to receive text messages is not a condition of any purchase.
- Message frequency varies based on your bookings and activity.
- Message and data rates may apply. Check with your mobile carrier for details about your plan.
- Opt-out: Reply STOP to cancel at any time. You will receive one final message confirming you have been unsubscribed, and no further messages will be sent unless you opt in again.
- Help: Reply HELP for help, or contact us at support@senditsoftware.com.
- Carriers are not liable for delayed or undelivered messages.
- Privacy: Your mobile information will not be shared or sold to third parties for marketing purposes. See our Privacy Policy for details.
By opting in, you confirm that you are the account holder of the mobile number you provide or have the account holder’s permission to enroll it. If you change or deactivate your mobile number, please reply STOP from that number first or let us know so we can update our records.

Our Privacy Policy explains how we collect, use, and protect your information, and is part of these Terms.
6. Third-Party Links and Services
The Site may link to websites or services operated by third parties. We do not control and are not responsible for their content, policies, or practices, and your use of them is at your own risk and subject to their terms.
7. Disclaimer of Warranties
The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any message will be delivered.
8. Limitation of Liability
To the fullest extent permitted by law, Send It Software and its members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim related to the Services will not exceed one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.
9. Indemnification
You agree to indemnify and hold harmless Send It Software and its members, employees, and agents from any claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of your misuse of the Services or your violation of these Terms.
10. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Services will be resolved in the state or federal courts located in Colorado, and you consent to the jurisdiction of those courts.
11. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated version on this page and change the effective date above. Your continued use of the Services after changes take effect means you accept the updated Terms.
